Are you a hospital civil servant? Your leave requests during the period from 1er November 2021 to March 6, 2022 inclusive were refused due to the health crisis? You can ask to benefit from a compensatory indemnity within the limit of 10 days.

Hospital public service employees benefit from a temporary derogation from the rules on leave not taken for service reasons and in the context of the fight against the Covid-19 epidemic. This measure was to end on January 31, 2022, it was extended until March 6, 2022 by an order published in the Official newspaper of February 12, 2022.

Who is concerned ?

To benefit from this derogation, your requests for leave or RTT during the period from November 1, 2021 to March 6, 2022 inclusive must have been refused due to the health crisis and you must be a civil servant or contract worker in one of the establishments. following:

  • public health establishments;
  • reception and hospital care centres;
  • local public establishments caring for the elderly;
  • local public establishments and establishments not endowed with legal personality managed by legal persons under public law taking care of minors or adults with disabilities, with adjustment difficulties or suffering from chronic pathologies.

What should be done ?

If you are in this situation, you have three choices:

  • postpone your leave;
  • request compensation;
  • pay your holidays and RTT into your time savings account.

What is the amount of the compensation?

The gross lump sum per day of the compensatory allowance depends on your statutory category:

  • 200 € per day for staff in category A;
  • 130 € per day for staff in category B;
  • 110 € per day for staff in category C.

Compensation is limited to 10 days of leave or RTT not taken.
