How long is parental leave?
Parental leave has an initial duration of 1 year maximum (article L.1225-48 of the Labor Code). It is taken continuously.
It can be renewed, in increments of 1 year maximum. Its renewal possibilities and its term vary according to the number of children born or adopted simultaneously.
The renewal can be for a longer or shorter period than the previous period.
The duration of parental leave in the event of birth or simple adoption
The duration of parental leave is renewable twice, and ends at the latest when the child is 3 years old, or 3 years after the child’s arrival in the event of the adoption of a child under 3 years old.
To note : in the event of the adoption of a child aged 3 to 16, the leave is 1 year non-renewable.
The duration of parental leave in the event of multiple births or adoptions
Following the birth or simultaneous adoption of 2 children, parental leave can be renewed twice, and ends at the latest when the child enters kindergarten or 3 years after the arrival of the children. children at home.
In the event of multiple births of at least 3 children or simultaneous arrivals of at least 3 adopted children, the leave can be extended 5 times, and ends at the latest when the children are 6 years old.
The duration of parental leave in the event of illness, serious disability or serious accident of the child
In these circumstances, the duration of parental leave can be extended by 1 year. (article L.1225-49 of the Labor Code). It is then necessary to have a medical certificate drawn up attesting that the seriousness of the event makes it necessary for a parent to be present with the child for a certain period.
Is it possible to take parental leave of 3 months?
For the initial parental leave, you are not obliged to take its maximum duration (which is 1 year). You can perfectly choose to take only 1 month, 3 months, or even 6 months for example. This decision is yours, within the limit of 12 months.
Each parental leave renewal period may be longer or shorter than the previous one. Again, you choose the number of months to renew. Within the limit of 12 months.
Early resumption of your professional activity
Can parental leave end prematurely? Yes, your parental leave can end before its scheduled end if agreed with your employer. And in this case, early resumption of your work is possible.
The request for early termination of parental leave, and therefore early return to work, must reach the employer by recorded delivery at least 1 month before the desired return date.
However, the employer’s agreement will not be necessary in 2 circumstances:
- In the event of the child’s death.
- In the event of a significant reduction in household resources (for a reason other than parental leave).
In all cases, parental education leave must be returned to the position previously held. However, if this is not available, the employee must find a similar job with at least equivalent remuneration.
